Terms of Service

Please read these Terms of Service carefully before using our website or engaging VivaPath Care LLC for home care services. These terms govern your relationship with us.

1. Acceptance of Terms

By accessing our website or engaging VivaPath Care LLC ("VivaPath," "we," "us," or "our") for services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our website or services.

2. Services Provided

VivaPath Home Care provides nurse-led wellness and home support services, including but not limited to:

  • RN Wellness & Support Visits
  • Home Safety Assessments
  • Home Cleaning
  • Laundry & Home Organization
  • Errands & Meal Preparation
  • Medication Organization

Important: VivaPath is not a home health agency and does not provide medical treatment, nursing care under a physician order, or services covered by Medicare or Medicaid. RN visits are educational and observational in nature. We do not diagnose, treat, or prescribe.

3. Service Agreement

Prior to beginning services, clients and/or their authorized family representative will complete a service agreement that outlines:

  • Specific services to be provided
  • Scheduling and frequency of visits
  • Rates and payment terms
  • Cancellation and rescheduling policies
  • Emergency protocols

These Terms of Service apply in addition to the specific service agreement you sign with VivaPath.

4. Payment Terms

VivaPath operates on a private-pay basis only. We do not bill insurance, Medicare, or Medicaid.

  • Payment is accepted via Stripe, PayPal, or Square
  • Payment terms are outlined in your individual service agreement
  • Errand and grocery costs are reimbursed separately with receipts provided
  • Returned payments may be subject to a processing fee

5. Cancellation Policy

We understand that schedules change. Our cancellation policy is as follows:

  • Cancellations made at least 24 hours in advance: No charge
  • Cancellations made with less than 24 hours notice: May be subject to a cancellation fee as outlined in your service agreement
  • Repeated last-minute cancellations may result in discontinuation of service

6. Client Responsibilities

To receive the best possible care, clients and their families agree to:

  • Provide accurate and complete health and household information
  • Maintain a safe working environment for our staff
  • Notify VivaPath promptly of any changes in health status, medications, or care needs
  • Treat VivaPath staff with respect and professionalism
  • Not ask VivaPath staff to perform services outside the scope of their role

7. Limitation of Liability

VivaPath Care LLC provides supportive and educational services. We are not a licensed home health agency, and our services do not constitute medical treatment. By engaging our services, you acknowledge:

  • VivaPath is not responsible for medical outcomes or health conditions
  • Our services supplement, but do not replace, care from licensed medical providers
  • In an emergency, clients or family should contact 911 or their physician directly
  • VivaPath’s liability is limited to the fees paid for the specific service at issue

8. Right to Refuse or Discontinue Service

VivaPath reserves the right to refuse or discontinue services in situations that include, but are not limited to:

  • Unsafe working conditions for our staff
  • Disrespectful or abusive behavior toward staff
  • Non-payment or repeated payment issues
  • Requests for services outside our scope of practice
  • Situations that require a level of care we are not licensed to provide

9. Confidentiality

VivaPath treats all client information with the highest level of discretion. Please refer to our Privacy Policy for details on how we collect, use, and protect your information.

10. Governing Law

These Terms of Service are governed by the laws of the State of Florida. Any disputes arising from these terms or your use of our services shall be resolved in the courts of Miami-Dade County, Florida.

11. Changes to Terms

We reserve the right to update these Terms of Service at any time. Updated terms will be posted on this page with a revised effective date. Continued use of our services after changes constitutes acceptance of the updated terms.
